What to Know About Green Card Renewal for Conditional Residents

In most cases, green cards (lawful permanent residency cards) are valid for a period of ten years and can be renewed indefinitely. However, there is an exception for immigrants receiving a spousal visa if they were married for less than two years. In this circumstance, green cards are on a “conditional” basis. Before your conditional green card expires, you must file an application to remove the conditions on your immigration status.

Eligibility Requirements for an I-751 Green Card Renewal

Officially known as a ‘Petition to Remove Conditions on Residence’ or ‘Form 1-751’, this application will allow for the transition to a non-conditional green card. It is imperative that you file Form 1-751 in a timely manner. A late filing could cause you and your partner significant problems. To get approval, you will need to submit the following:

  • A completed Form I-751;
  • Copies of your current conditional green card; and
  • Evidence that your marriage was entered into in good faith.

In general, a Form I-751 should be filed jointly. The process is far easier if the spouse who sponsored the conditional green card can help. However, if you cannot submit a joint application—either because your spouse passed away, you got divorced, or you are suffering from abuse—you are not out of options. You have the right to petition for removal on your own.
